Terms and Conditions

1. Jurisdiction
2. This Agreement is governed by the law in force in the jurisdiction of New South Wales.

The Parties submit to the exclusive jurisdiction of the courts of New South Wales.

2. Definitions
3. In these Terms and Conditions, unless the context otherwise requires (whether

capitalised or not):

1. “BAGT”/”Us”/”We”/”Our” means Marsue Northern Rivers Pty Ltd ACN 130

269 822 trading as Bali Asta Golf Tours.

1. “You”/”Your”/”The Client” means any client engaging the services of BAGT

and includes any person entering into the booking or signing this agreement,

and anyone being booked for on that persons behalf.

iii. “Booking” means the activity or set of activities booked on Your behalf by

BAGT.

3. Application of these terms and conditions
4. These terms and conditions apply to the person making the booking and all other

person on whose behalf the booking is made.

4. Agent only
5. Bali Asta Golf Tours (BAGT) acts solely as an agent.
6. BAGT, as agent, facilitates agreements between the client (you) and providers.
7. All arrangements between you and providers is a direct relationship between the two

parties and BAGT and its related entities, directors, employees, or agents, do not

assume liability for any loss or damage resulting from that arrangement.

1. Any alterations, amendments, or circumstances occurring subsequent to the

commencement of the tour, which are beyond the control and scope of BGAT’s role as

agent, including but not limited to tee times, availability of transport, room

assignments, or any issues arising with the service providers in Bali, shall be

considered events beyond the purview and responsibility of BGAT. BGAT shall not be

held liable or accountable for such events, and any resulting consequences or costs

shall be the sole responsibility of the client and the respective service provider

involved.

5. Services
6. BAGT offers the service of providing bespoke golf tours in Bali, Indonesia. The tour

package includes set tee times, transfers to and from your hotel accommodation to the

golf courses and between locations on the day trips, and hotel accommodation.

6. Your responsibilities
7. You are responsible for your own travel arrangements to and from Bali.
8. You warrant that you are physically fit and capable of performing the activities in your

booking.

1. Failure by You to be in Bali at the allocated time to utilise bookings made on your

behalf is your responsibility and You may not make any claim on BAGT in this regard.

1. Each person in a booking must have travel insurance before embarking one of

BAGT’s tours.

1. All clients participating in BAGT’s tours or activities agree to receive necessary

medical treatment in the case of any injury, accident, or illness during the course of

the activity or tour.

1. Each person in a booking is responsible for their own passport being valid for the

period of travel and that all necessary visas and permits for travel to Bali and

satisfying any travel requirements of the destinations visited or transited during the

tour.

1. You must ensure you meet vaccination requirements for any activities undertaken as

part of your tour.

7. Acceptance of risk
8. To be involved in a booking with BAGT means you agree to release BAGT from all

liability in relation to and accept all associated risks with participation. This includes

but is not limited to death, any physical or mental injury, and any loss sustained. You

acknowledge that there are risks involved in participating in sporting activities,

international travel, and group settings and accept that all associated risks involved

with engaging with providers or other participants.

1. BAGT’s services come with guarantees that cannot be excluded under the Australian

consumer law. Nothing in these terms purports to modify or exclude the conditions,

warranties, undertakings and legal rights under the Australian Competition and

Consumer Act and other local laws. Any and all other warranties or conditions are

expressly excluded, including liability for incidental or consequential damages caused

by breach of any express or implied warranty or condition.

8. Privacy

10. Personal information collected by BAGT may include any information required

to assist in providing you with a booking:

1. Title (gender), name, date of birth, address, email address, postcode,

nationality, credit card and payment details including billing address,

travel details, passport number, dietary requirements, other information

relevant to travel arrangements.

1. Storage:
2. BAGT may store your records of information electronically or on paper records

in secure premises.

1. Purpose:
2. Your information is collected for the sole purpose of assisting BAGT to provide

its service of making bookings with third party service providers and

corresponding with you on terms of the booking. BAGT may share your

information with third party travel service providers, pursuant to the exemptions

set out in the Privacy Act 1998 (Cth).

1. Should BAGT use any of your personal information for direct marketing

purposes, you may unsubscribe from receiving any communications from

BAGT at any time.

9. Changes in prices or itinerary
10. All pricing is in Australian dollars.
11. Prices are subject to change due to provider changes, currency fluctuations and other

factors without prior notification.

1. Should the prices differ in any material way from the original booking, you will be

offered to either cancel or accept within 14 days of receipt of notice

11. BAGT accepts direct payment via the following payment methods:

Clients must use the last name of the person who processed the booking and

the booking reference in the deposit and communicate in writing to BAGT

notifying of the deposit.

1. Payment Terms:
2. A deposit of 20% per person must accompany booking applications.
3. Full payment of the balance is due 4 weeks prior to the first activity in your

booking.

iii. Your booking is not secured until fully paid and confirmed by BAGT.

11. Cancellation Policy and Refunds
12. Client cancellation must be communicated to BAGT in writing at least 7 days prior to

the tour departure date for a full refund.

1. Any deposit paid will be forfeited upon late cancellation and will be used to satisfy the

cancellation fee payable, or part thereof.

1. No refunds will be made once the tour has commenced, and no refunds will be

available for any element of the booking if not utilized during the tour.

12. Cancellation due to Unavoidable or Extraordinary Circumstances
13. If a booking is cancelled by BAGT other than for the reason of a Force Majeure, no

cancellation fee will be payable. You will be offered the option to reschedule your tour

within 12 months or receive a full refund.

1. If a booking is cancelled by BAGT for the reason of a force majeure meaning an

unforeseeable and unavoidable event that prevents BAGT and clients from fulfilling its

obligations safely or lawfully, including a relevant travel warning by Australian travel

authorities such as Smart Traveller, BAGT reserves the right to provide you with the

right to reschedule. If rescheduling is not feasible, BAGT’s reserves the right to

provide you with a credit voucher valid for 12 months or to offer a refund after

deducting any considerable costs or losses incurred.

13. General
14. For us to waive a right under these terms, the waiver must be in writing.
15. If any part or provision of these terms is or becomes illegal, unenforceable, or invalid,

that part or provision is deemed to be modified to the extent required to remedy the

illegality, unenforceability or invalidity. If a modification is not possible, the part or

provision must be treated for all purposes as severed from these terms. The

remainder of these terms will be binding on you.

14. Intellectual Property
15. All content and concepts in your booking are intellectual property owned by us.
16. You may not modify, publish, transmit, participate in the transfer or sale of, create

derivative works from, distribute, display, reproduce or perform, or in any way exploit

in any format whatsoever any of our intellectual property, in whole or in part, without our prior written consent.
